Terms of Use

These terms govern your use of the Toasty iOS app and toastyuv.com. By installing or using Toasty, you agree to them. If you don’t agree, don’t install the app.

1. What Toasty is (and isn’t)

Toasty is a personal UV and burn-time forecasting tool. It estimates how the sun will interact with your skin today, given your Fitzpatrick skin type, SPF habits, and Apple Weather’s UV data.

Toasty is not a medical device and does not provide medical advice. It does not diagnose, treat, cure, or prevent any condition — including skin cancer. UV radiation from sun exposure is a known carcinogen. Any sun exposure carries inherent skin cancer and premature aging risk, even within Toasty’s estimated limits. Burn times are approximations based on published models and will vary with medications, altitude, surface reflection, dehydration, and individual skin sensitivity.

Before using Toasty, consult a dermatologist if you have a personal or family history of skin cancer; take photosensitizing medication (tetracyclines, retinoids, diuretics, some antidepressants, St. John’s Wort); have an autoimmune condition (lupus, vitiligo, xeroderma pigmentosum); or are pregnant.

You use Toasty at your own risk. Always wear SPF 30+ broad spectrum sunscreen, reapply every two hours, seek shade during peak UV, and never allow yourself to burn.

2. Your license

We grant you a personal, non-transferable, non-exclusive license to install and use Toasty on Apple devices you own or control, subject to these terms and the Apple Media Services terms.

3. Subscriptions and billing

Toasty Pro is available as:

• Monthly:an auto-renewing monthly subscription. Price is shown in the app’s purchase flow and in App Store Connect, in your local currency.
• Lifetime: a one-time purchase that unlocks Toasty Pro for the lifetime of the app on your Apple ID.

Auto-renewal: a Monthly subscription renews automatically at the end of each period unless auto-renewal is turned off at least 24 hours before the period ends. Your Apple ID is charged within 24 hours of the end of the current period at the then-current rate. You can manage or cancel your subscription at any time in your Apple ID settings (Settings → [your name] → Subscriptions). Canceling stops the next renewal; it does not refund the current period.

Refunds: all purchases go through Apple. Refunds are handled by Apple, not Toasty. Request a refund at reportaproblem.apple.com.

Free trials (if offered): the free period is shown in the purchase flow. Canceling before the trial ends prevents the first charge. Unused portions of a free period are forfeited when you cancel.

4. Acceptable use

You agree not to:

• Use Toasty in a way that could injure yourself or others — Toasty is a forecast, not an override for common sun-safety sense.
• Reverse-engineer, decompile, or scrape the app or our servers.
• Abuse the app or the underlying services (excessive API calls, automated behavior, circumventing subscription gating).

5. Your data

How we handle your data is described in our Privacy Policy.

6. Intellectual property

Toasty, the Toasty name, the Passport design, copy, artwork, and code are ours. You get a license to use the app — you don’t get ownership of anything.

7. Disclaimers and limitation of liability

Toasty is provided “as is” without warranty of any kind, express or implied. We do not warrant that forecasts will be accurate, uninterrupted, or suitable for any particular purpose. To the maximum extent allowed by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the app — including, without limitation, any sunburn, skin damage, or medical condition. Some jurisdictions don’t allow these exclusions; in those places our liability is limited to the minimum allowed by law.

8. Apple-specific terms

You acknowledge that these terms are between you and Toasty — not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app (including product liability, legal or regulatory claims, or consumer-protection claims). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

9. Termination

You can stop using Toasty at any time. We can suspend or terminate your access if you violate these terms or if we stop operating the service. If we discontinue Toasty, we’ll give reasonable notice when practical.

10. Changes to these terms

We may update these terms. Material changes will be announced in the app before they take effect, and the “Last updated” date above will change. Continued use after a change means you accept the new terms.

11. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New Jersey, unless a consumer-protection law in your jurisdiction requires otherwise.
